Terms of Use and End User License Agreement

Welcome to Water Eject, provided by Denali Digital Bilişim Limited Şirketi (“we,” “us,” or “our”). These Terms of Use and End User License Agreement (“Terms”) govern your access to and use of the Water Eject mobile application and related digital services (“Application,” “App,” or “Water Eject”).

By downloading, accessing, or using the Application, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Application.

Water Eject is a utility application designed to help users play specific sound waves, vibration patterns, bass tones, and audio tests that may assist with removing water or dust from phone speakers, earpieces, or other sound output areas. The App also includes speaker testing, tone testing, and decibel measurement features.

The Application does not guarantee that water, dust, sand, or any other substance will be fully removed from your device. The Application is not a repair service and is not a substitute for professional device inspection, cleaning, or technical support.

1. Acceptance of Terms

By accessing or using the Application, you confirm that you have read, understood, and agree to be legally bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not access or use the Application.

You must be at least 13 years old to use the Application. If you are under the age required by applicable law to use digital services, you may use the Application only with the consent and supervision of a parent or legal guardian.

2. Changes to Terms

We reserve the right to modify, update, or replace these Terms at any time.

If we make material changes, we may notify you through the Application, by email, or by other reasonable means. Your continued use of the Application after any changes become effective constitutes your acceptance of the updated Terms.

If you do not agree to the updated Terms, you must stop using the Application.

3. Privacy Policy and Data Collection

Your access to and use of the Application is also governed by our Privacy Policy. The Privacy Policy explains how we collect, use, process, store, and disclose information when you use the Application.

By using the Application, you acknowledge that your information may be processed in accordance with our Privacy Policy.

The Application may request the following permissions and access:

Microphone Access: May be used for the DB Meter feature to measure sound levels from the device’s environment or sound output. The microphone is used only to support decibel measurement functionality where applicable.

Internet and Network Access: Required for certain online functionalities, analytics, advertising, subscription validation, cloud-based services, updates, or other connected features.

Notification Permission: May be used to send reminders, app updates, feature notices, or subscription-related messages, if you enable notifications.

App Tracking Permission: Where applicable, the App may request permission under Apple’s App Tracking Transparency framework for advertising, attribution, or analytics purposes.

The Application does not require camera access for its core features.

The Application does not collect, process, store, or use face data.

The Application does not use facial recognition.

The Application does not create biometric templates, faceprints, or facial recognition profiles.

The Application does not require access to Apple Health, HealthKit, or similar health data platforms for its core features.

We do not collect sensitive financial data such as full credit card details. In-app purchases and subscriptions are processed by Apple through the App Store.

4. Application Features

Water Eject may include, but is not limited to, the following features:

Water Eject: Allows users to play sound waves, including frequencies between approximately 80 Hz and 160 Hz, that may help push water out of phone speakers, earpieces, or similar sound output areas.

Dust Eject: Allows users to play rhythmic bass sounds that may help loosen or remove dust, sand, or small particles from speaker areas.

Speaker Check: Allows users to test speakers, earpieces, and other sound outputs individually or together by playing test sounds.

Tone: Allows users to test speaker or earpiece sound quality using different waveforms, including sine, saw, square, and triangle tones.

DB Meter: Allows users to check or estimate sound levels using decibel measurement functionality, where available and supported by the device.

Premium Features: Certain features, usage limits, sound modes, frequency options, testing tools, or advanced utilities may require an active subscription or in-app purchase.

5. No Guarantee of Water, Dust, or Sand Removal

The Application is intended to provide sound-based utility tools that may assist with water, dust, or sand removal from device speaker areas.

However, you understand and agree that:

The App does not guarantee successful removal of water, dust, sand, or any other substance.

The App does not guarantee that your speaker, earpiece, microphone, or device will return to normal performance.

The App does not repair physical damage, liquid damage, corrosion, hardware failure, blocked components, or speaker defects.

The App does not replace professional cleaning, repair, or technical inspection.

Results may vary depending on the device model, speaker structure, amount of water or dust, hardware condition, case design, volume level, environmental conditions, and other factors.

If your device has been exposed to significant liquid, sand, dust, or physical damage, you should contact the device manufacturer or a qualified repair professional.

6. Safe Use of Sounds, Frequencies, and Vibrations

The Application may generate loud sounds, low-frequency sounds, bass sounds, test tones, vibrations, and waveform-based audio.

You agree to use the Application carefully and responsibly.

You should:

Start at a low volume before increasing sound level.

Avoid placing the device directly next to your ear while sounds are playing.

Avoid using the App with headphones, earphones, or earbuds.

Stop using the App immediately if the sound causes discomfort, pain, ringing, dizziness, irritation, or any other negative reaction.

Avoid using the App around infants, children, pets, or people sensitive to loud sounds.

Avoid using the App near hearing aids, medical devices, or sensitive electronic equipment.

Avoid using the App continuously for excessive periods.

We are not responsible for hearing discomfort, device issues, speaker damage, sound distortion, hardware problems, or other consequences resulting from misuse, excessive volume, prolonged use, or unsafe use of the Application.

7. DB Meter Disclaimer

The DB Meter feature may estimate or measure sound levels using the device microphone or other available device sensors.

You understand and agree that DB Meter results may be approximate and may vary depending on:

Device model.

Microphone quality.

Device case or cover.

Distance from the sound source.

Environmental noise.

Calibration differences.

Operating system limitations.

Hardware condition.

The DB Meter feature is not a professional sound measurement instrument and should not be used for legal, occupational safety, industrial, medical, scientific, or regulatory compliance purposes.

For professional decibel measurement, you should use certified sound level measurement equipment.

8. User Responsibility

You are solely responsible for how you use the Application and any decisions you make based on its outputs or test results.

You agree that you will not use the Application in a way that may damage your device, disturb others, violate laws, or create unsafe conditions.

You are responsible for checking your device manufacturer’s recommendations before using sound or vibration-based cleaning methods.

If your device is under warranty, has liquid damage, has visible hardware damage, or produces abnormal sound, you should consult the manufacturer or an authorized repair provider before using the App.

9. Account Registration, Access, and Deletion

Certain features of the Application may be available without creating an account. Other features may require an account, device-based identifier, subscription entitlement, or third-party authentication.

If account registration is available, you agree to provide accurate and current information and to keep your account credentials secure.

You are responsible for all activity that occurs under your account or device-based access.

If the Application provides account deletion functionality, you may request deletion of your account and associated data through the Application or by contacting us at support@denalidigital.co.

Upon deletion, we will delete or anonymize personal data associated with your account where required by applicable law, unless retention is necessary for legal compliance, fraud prevention, dispute resolution, security, backup, or legitimate business purposes.

10. Permissions and Device Settings

You may enable or revoke permissions at any time through your device settings.

However, disabling permissions may limit or prevent certain features from working properly.

For example:

Disabling microphone access may prevent the DB Meter feature from functioning properly.

Disabling notifications may prevent you from receiving reminders or App notices.

Disabling internet access may prevent subscription validation, analytics, ads, or online features from working properly.

You are responsible for managing device permissions according to your preferences.

11. Third-Party Services and Integrations

The Application may use third-party services and integrations, including but not limited to:

Cloud hosting and storage providers.

Analytics and crash reporting tools.

Subscription and in-app purchase infrastructure providers.

Advertising and attribution providers.

Customer support tools.

App Store distribution and payment systems.

These third-party services may process certain information as described in our Privacy Policy.

We are not responsible for the content, availability, security, privacy practices, or policies of third-party services, websites, platforms, or integrations that are not controlled by us.

Your use of third-party services may be subject to their own terms and privacy policies.

12. In-App Purchases and Subscriptions

Certain features of the Application may require an in-app purchase, subscription, or premium access.

All purchases made through the iOS Application are processed by Apple through the App Store. We do not process or store your full payment card information.

Subscription plans, prices, trial periods, renewal periods, and included features may be displayed inside the Application before purchase.

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current subscription period, subject to Apple’s App Store rules.

Your Apple ID account may be charged for renewal within 24 hours before the end of the current subscription period.

You can manage or cancel your subscription through your Apple ID account settings.

Deleting the Application does not automatically cancel your subscription.

Refund requests are handled by Apple according to Apple’s App Store policies. We do not control Apple’s refund decisions.

We reserve the right to modify, add, remove, limit, or discontinue premium features, pricing, trial availability, or subscription offerings at any time, subject to applicable law and App Store rules.

13. Free Trials and Promotional Offers

The Application may offer free trials, discounted subscriptions, promotional offers, or limited-time access to premium features.

Eligibility for trials or promotions may be limited and may vary by user, region, device, platform, or subscription history.

Unless canceled before the end of the trial period, a free trial may automatically convert into a paid subscription according to the terms shown at the time of purchase.

14. Acceptable Use

You agree not to:

Use the Application for unlawful, harmful, fraudulent, abusive, or misleading purposes.

Use the Application in a way that may intentionally damage devices, speakers, earpieces, microphones, or hardware components.

Play sounds from the Application in a way that intentionally disturbs, harasses, frightens, or harms other people or animals.

Use the Application at unsafe volume levels.

Use the Application with headphones, earphones, or earbuds at high volume.

Attempt to bypass subscriptions, paywalls, security systems, usage limits, or access controls.

Attempt to extract, scrape, copy, reverse engineer, decompile, modify, or create derivative works from the Application.

Use automated tools, bots, scripts, or similar technologies to access or abuse the Application.

Interfere with or disrupt the operation, servers, networks, or security of the Application.

Use the Application in a way that violates applicable laws, intellectual property rights, privacy rights, or these Terms.

15. Intellectual Property Rights

The Application, including but not limited to software, design, user interface, graphics, branding, logos, text, features, functionality, audio patterns, sound modes, databases, algorithms, and other materials, is owned by or licensed to Denali Digital Bilişim Limited Şirketi and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to download, install, and use the Application for personal, non-commercial purposes in accordance with these Terms.

You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, or otherwise exploit any part of the Application without our prior written permission.

16. End User License Agreement

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Application on devices that you own or control, solely for your personal and non-commercial use.

This license does not transfer ownership of the Application to you.

You may not:

Rent, lease, lend, sell, redistribute, or sublicense the Application.

Copy, decompile, reverse engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Application, except where such restriction is prohibited by applicable law.

Remove, alter, or obscure any copyright, trademark, or proprietary notices.

Use the Application for any purpose not expressly permitted by these Terms.

If you downloaded the Application from the Apple App Store, your use of the Application must also comply with Apple’s App Store Terms of Service.

Apple is not responsible for providing maintenance or support services for the Application.

In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price for the Application, if applicable, in accordance with Apple’s policies. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Application.

Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms as they relate to your license to use the Application on Apple-branded products. Upon your acceptance of these Terms, Apple has the right to enforce these Terms against you as a third-party beneficiary.

17. Content Availability and Changes

We may update, modify, replace, limit, suspend, or discontinue any part of the Application at any time.

We do not guarantee that any specific feature, sound mode, frequency range, tone, DB Meter function, speaker test, premium feature, or utility tool will always be available.

Some features may depend on internet connectivity, device compatibility, operating system limitations, speaker hardware, microphone access, subscription status, third-party providers, or App Store rules.

18. User Conduct and Moderation

We reserve the right to suspend, restrict, or terminate access to the Application if we believe that you have violated these Terms, applicable law, third-party rights, or the security of the Application.

We may also take steps to prevent fraud, abuse, unauthorized access, subscription misuse, or misuse of sound-based features.

19. No Professional Repair Advice

Water Eject is not a professional repair, cleaning, diagnostic, or technical inspection service.

The App does not diagnose hardware damage, liquid damage, corrosion, speaker failure, microphone failure, earpiece failure, or other device defects.

The App’s speaker checks, tone tests, and DB Meter features are utility tools only and may not accurately identify all device issues.

For serious water exposure, sand exposure, distorted sound, abnormal speaker behavior, reduced audio quality, or suspected device damage, you should contact the device manufacturer, authorized service provider, or qualified repair professional.

20. Disclaimer of Warranties

The Application is provided on an “AS IS” and “AS AVAILABLE” basis.

To the maximum extent permitted by applicable law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not guarantee that:

The Application will be uninterrupted, secure, or error-free.

The Application will meet your expectations or personal goals.

Water Eject will remove all water from your device.

Dust Eject will remove all dust, sand, or particles from your device.

Speaker Check will accurately detect all speaker or earpiece problems.

Tone tests will accurately measure sound quality.

DB Meter results will be fully accurate or professionally calibrated.

The Application will prevent, reduce, or repair liquid damage, dust damage, or hardware damage.

Any errors or defects will be corrected.

You use the Application at your own discretion and risk.

21. Limitation of Liability

To the maximum extent permitted by applicable law, Denali Digital Bilişim Limited Şirketi, its owners, directors, employees, contractors, partners, service providers, and affiliates shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, loss of data, loss of device functionality, speaker damage, microphone damage, earpiece damage, hardware damage, hearing discomfort, business interruption, or other losses arising from or related to your use of the Application.

We are not liable for:

Water, dust, sand, or particles not being removed from your device.

Existing or future liquid damage, corrosion, speaker issues, microphone issues, or hardware defects.

Damage resulting from high volume, prolonged use, misuse, unsafe use, or failure to follow device manufacturer instructions.

Incorrect or approximate DB Meter results.

Service interruptions, technical errors, or third-party provider failures.

Unauthorized access resulting from your failure to secure your device, account, or credentials.

Your sole remedy for dissatisfaction with the Application is to stop using it and, where applicable, cancel your subscription through your App Store account settings.

22. Indemnification

You agree to indemnify, defend, and hold harmless Denali Digital Bilişim Limited Şirketi, its owners, directors, employees, contractors, partners, service providers, and affiliates from and against any claims, damages, liabilities, losses, costs, or expenses arising from:

Your use or misuse of the Application.

Your violation of these Terms.

Your violation of any applicable law or third-party right.

Your unsafe use of sounds, frequencies, vibrations, speaker tests, tone tests, or DB Meter features.

Any damage or claim related to your device, speaker, microphone, earpiece, or other hardware resulting from your use of the Application.

23. Termination

We may suspend or terminate your access to the Application at any time if we believe you have violated these Terms, created risk or legal exposure for us, or used the Application in a harmful, fraudulent, or unlawful way.

You may stop using the Application at any time.

Termination does not automatically cancel active subscriptions. You must cancel subscriptions through your Apple ID or App Store account settings.

Sections that by their nature should survive termination shall remain in effect, including intellectual property, disclaimers, limitation of liability, indemnification, governing law, and dispute-related provisions.

24. Export and Legal Compliance

You agree to comply with all applicable laws and regulations when using the Application.

You represent that you are not located in a country or region subject to applicable trade sanctions or embargoes and that you are not listed on any applicable restricted party list.

25. Governing Law

These Terms are governed by the laws of the United Kingdom, without regard to conflict of law principles, unless otherwise required by applicable consumer protection laws.

You agree that any disputes arising out of or relating to these Terms or the Application shall be subject to the exclusive jurisdiction of the competent courts of the United Kingdom, unless applicable law provides otherwise.
