Terms of Use

We are Denali Digital, a company established under the laws of the Republic of Türkiye, developing and publishing mobile applications available via platforms such as the Apple App Store and Google Play Store (the "Apps").

These Terms of Use ("Agreement") govern your use of Photo Editor, Makeup: Retouch and related services (the "Services").

By downloading, accessing, or using the Services, you agree to this Agreement. If you do not agree, you must not use the Services.

1. About

By using our App, you agree to this Agreement and our Privacy Policy.

Your relationship with Denali Digital is governed solely by:

• This Agreement
• Our Privacy Policy

Each time you download or use the App, you accept the latest version of these terms.

You confirm that:

• You are at least 16 years old
• If under 18, you have parental consent
• You use the App for personal, non-commercial purposes only

2. End-User License Agreement

2.1 License

We grant you a non-exclusive, non-transferable, revocable license to use the App for personal use on devices you own or control.

2.2 Local Laws

You are responsible for complying with all applicable laws and regulations.

2.3 Modification

We may modify, update, suspend, or discontinue any feature of the App at any time without notice.

2.4 Ownership

The App is licensed, not sold.

All rights, including:

• Software
• Design
• AI models
• Features (Makeup, Lip Plump, Acne Remover, Photo Fixer)

belong to Denali Digital.

2.5 Ads

The App may display advertisements including:

• Banner ads
• Interstitial ads
• Rewarded ads

3. User Content

3.1 User Content

You are responsible for all content you upload, including:

• Photos (face or body images)
• Edited images

You confirm that your content:

• Does not violate any law
• Does not infringe rights of others

We may remove content at any time.

3.2 License

You grant Denali Digital a limited, worldwide, royalty-free license to process your content only to provide app functionality (e.g., photo editing).

We do NOT:

• Sell your content
• Use it for AI training
• Share it with third parties

3.3 Feedback

Any feedback you provide may be used freely by Denali Digital without compensation.

3.4 Acceptable Use Policy

You may not use the App to:

• Violate intellectual property rights
• Upload harmful, offensive, or illegal content
• Exploit or harm minors
• Distribute spam or scams
• Upload viruses or malicious code
• Attempt unauthorized access to systems

3.5 Enforcement

We may review, remove, or restrict content at our discretion.

4. Term and Termination

This Agreement remains valid until terminated.

We may terminate access:

• Immediately for violations
• With notice for other reasons

You may terminate by deleting the App.

Upon termination:

• Your access ends
• Your data may be deleted

5. Indemnity

You agree to indemnify Denali Digital against claims arising from:

• Your use of the App
• Your uploaded content
• Your violation of this Agreement

6. Third Parties

6.1 App Stores

This Agreement is between you and Denali Digital, not Apple or Google.

6.2 Third-Party Services

If the App integrates third-party tools, their terms apply separately.

6.3 Other Users

We are not responsible for interactions between users.

6.4 Release

You release Denali Digital from claims related to third parties.

7. Disclaimers

The App is provided "as is".

We do not guarantee:

• Error-free operation
• Perfect results from AI editing
• Continuous availability

AI-generated or edited results (e.g., makeup, retouching) may vary and are for entertainment and aesthetic purposes only.

8. Limitation of Liability

Denali Digital is not liable for:

• Indirect damages
• Data loss
• Result dissatisfaction

Maximum liability is limited to the amount paid in the last 12 months.

9. Fees and Payments

9.1 In-App Purchases

The App may offer:

• Credits
• Premium features
• Editing tools

These are:

• Non-transferable
• Non-refundable (except where required by law)
• Have no real-world value

9.2 Subscriptions

We may offer auto-renewable subscriptions.

Subscription Terms:

• Payment is charged upon confirmation
• Subscription renews automatically unless canceled at least 24 hours before the end of the period
• Renewal is charged within 24 hours before expiration
• Subscriptions are managed via your App Store / Google Play account

Free Trial:

• Free trials may be offered
• If you subscribe, unused trial time is forfeited

Cancellation:

• You must cancel through your App Store account
• No cancellation during active subscription period

Pricing:

• Prices may vary by country
• Local currency conversion may apply

10. Miscellaneous

10.1 Changes

We may update these Terms. Continued use after updates means acceptance.

10.2 Notice

If any provision is invalid, others remain in effect.

10.4 Entire Agreement

This Agreement and Privacy Policy form the entire agreement.

11. Apple App Store Terms

If downloaded via Apple:

• Apple is not a party to this Agreement
• Apple provides no support
• Apple is not responsible for claims
• You must comply with Apple usage rules

12. App Functionality Disclaimer (Important)

Photo Editor, Makeup: Retouch provides AI-based editing tools including:

• Lip Plump
• Makeup filters
• Acne removal
• Skin smoothing
• Photo enhancement

These features:

• Modify images visually only
• Do not represent real-world results
• Should not be considered medical, cosmetic, or professional advice
