Terms of Use and End User License Agreement

Welcome to Morning Clock, Smart Loud Alarm ("App").

These Terms of Use and End User License Agreement ("Terms") constitute a legally binding agreement between you and Denali Digital Bilişim Limited Şirketi ("Company", "we", "us", or "our") governing your download, installation, access to, and use of the App.

By downloading, installing, accessing, or using the App, you agree to be bound by these Terms.

If you do not agree with these Terms, you must not use the App.

1. License

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the App on devices that you own or control.

This license is provided solely for your personal, non-commercial use unless expressly authorized by us.

The App is licensed, not sold.

2. Purpose of the App

Morning Clock, Smart Loud Alarm is designed to help users wake up by providing customizable alarms and interactive wake-up challenges.

Depending on your settings, the App may require you to complete one or more tasks before an alarm can be dismissed, including:

• Solving mathematics problems
• Shaking your device
• Typing displayed text correctly
• Completing a selected number of steps
• Other supported wake-up challenges

The App also allows users to select supported alarm sounds or music for alarm playback.

3. Eligibility

You must be legally capable of entering into binding agreements under the laws applicable in your country.

If you are under the age required to independently use digital services in your jurisdiction, you must use the App with the permission of your parent or legal guardian.

4. Alarm Reliability

Although we work continuously to improve reliability, we cannot guarantee that alarms will always activate exactly as expected.

Alarm performance may be affected by factors outside our control, including but not limited to:

• Device power status
• Battery-saving modes
• Operating system restrictions
• Notification permissions
• Silent or Focus modes
• Hardware failures
• Software updates
• Device manufacturer limitations
• Volume settings
• Connected Bluetooth or audio devices
• User settings
• Force-closing the App

You acknowledge that the App should not be relied upon as the sole method for waking up for:

• Flights
• Medical appointments
• Emergency situations
• Work obligations
• School examinations
• Safety-critical activities
• Any event where a missed alarm could cause significant damage.

5. Permissions

Certain App features require permissions granted by you.

Depending on the features you use, the App may request permission to access:

• Notifications
• Motion sensors
• Motion & Fitness / Activity Recognition
• Step count information
• HealthKit or Health Connect (where applicable)
• Media library or audio files
• Storage or file picker (when selecting alarm sounds)

You may revoke these permissions at any time through your device settings.

Disabling permissions may prevent certain App features from functioning correctly.

6. User Responsibilities

You agree to:

• Use the App only for lawful purposes.
• Configure alarms responsibly.
• Verify that notification permissions remain enabled.
• Keep your operating system updated.
• Ensure sufficient battery power for alarms.
• Select wake-up challenges appropriate for your physical abilities.

You agree not to:

• Reverse engineer the App.
• Attempt to bypass wake-up challenges.
• Modify the App.
• Distribute unauthorized copies.
• Use automated tools to interfere with App functionality.
• Circumvent subscription or purchase mechanisms.
• Violate applicable laws while using the App.

7. Health and Safety

The App is designed for productivity and wake-up assistance only.

It is not:

• a medical device;
• a healthcare product;
• a sleep-monitoring device;
• intended to diagnose, prevent, monitor, or treat any medical condition.

If you choose a step-count challenge or shake challenge, you are responsible for ensuring that it is safe for you to complete.

Do not complete wake-up challenges:

• while driving;
• while cycling;
• while operating machinery;
• in dangerous environments;
• if doing so could cause injury.

8. No Face Recognition or Biometric Processing

The App does not use:

• facial recognition;
• face scanning;
• facial authentication;
• biometric identification;
• biometric templates;
• face geometry analysis.

No face data is collected, stored, processed, sold, or shared.

9. Music and Alarm Sounds

The App may allow you to choose supported music or audio files as alarm sounds.

You remain solely responsible for ensuring that you have the right to use any music or audio files you select.

The Company does not claim ownership of your music library.

10. Purchases and Subscriptions

Certain App features may require:

• subscriptions;
• premium upgrades;
• in-app purchases.

All purchases are processed by the applicable app marketplace, including Apple App Store or Google Play.

Payments, refunds, cancellations, renewals, and billing are governed by the applicable marketplace's policies.

We do not process or store your credit card information.

11. Intellectual Property

The App, including its:

• software;
• interface;
• graphics;
• design;
• trademarks;
• logos;
• sounds;
• source code;
• documentation;

are owned by Denali Digital Bilişim Limited Şirketi or its licensors and are protected by applicable intellectual property laws.

Except as expressly permitted by these Terms, you may not:

• copy;
• modify;
• distribute;
• lease;
• sublicense;
• sell;
• decompile;
• reverse engineer;
• create derivative works.

12. Third-Party Services

The App may rely on third-party services for functionality such as:

• cloud infrastructure;
• subscription validation;
• crash reporting;
• analytics;
• notification delivery.

Those services operate under their own terms and privacy policies.

We are not responsible for third-party services or their availability.

13. Updates

We may release updates, bug fixes, improvements, or new features.

Some updates may be required for continued operation of the App.

We are not obligated to continue supporting older App versions indefinitely.

14. Suspension and Termination

We reserve the right to suspend or terminate your access to the App if you:

• violate these Terms;
• misuse the App;
• attempt unauthorized access;
• interfere with App security;
• engage in fraudulent activities.

Termination does not affect rights or obligations accrued before termination.

15. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis.

To the maximum extent permitted by law, we disclaim all warranties, including but not limited to:

• merchantability;
• fitness for a particular purpose;
• non-infringement;
• uninterrupted availability;
• error-free operation.

We do not guarantee that:

• alarms will always trigger;
• alarms will always wake you;
• every wake-up challenge will function under every circumstance;
• the App will always be compatible with every device or operating system version.

16. Limitation of Liability

To the maximum extent permitted by law, Denali Digital Bilişim Limited Şirketi shall not be liable for any:

• indirect damages;
• incidental damages;
• consequential damages;
• loss of profits;
• missed appointments;
• missed work;
• missed flights;
• missed examinations;
• missed alarms;
• data loss;
• device damage;
• personal injury resulting from misuse of the App.

Your use of the App is entirely at your own risk.

Some jurisdictions do not allow certain liability exclusions. In those jurisdictions, our liability will be limited to the maximum extent permitted by law.

17. Indemnification

You agree to indemnify and hold harmless Denali Digital Bilişim Limited Şirketi and its directors, employees, affiliates, and licensors against claims, damages, liabilities, and expenses arising from:

• your misuse of the App;
• violation of these Terms;
• violation of applicable law;
• infringement of third-party rights.

18. Privacy

Your use of the App is also governed by our Privacy Policy.

Please read the Privacy Policy carefully before using the App.

19. Changes to these Terms

We may modify these Terms from time to time.

Material updates may be communicated through:

• the App;
• the App Store;
• Google Play;
• or other appropriate means.

Continued use of the App after updated Terms become effective constitutes acceptance of the revised Terms.

20. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of Türkiye, without regard to conflict-of-law principles.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts and enforcement offices of Türkiye, unless otherwise required by mandatory consumer protection laws.
